$10.3 Million Settlement for 94-Year-Old Plaintiff

In January 2025, Breit Biniazan reached a $10.3 million settlement on behalf of our 94-year-old plaintiff whose life had been upended due to the carelessness of a box truck driver. Our attorneys Kevin Biniazan, Jeffrey Breit, and Alexis Bale, along with our co-counsel Paul Mack and Bob Pfeifer, worked diligently to prepare this case for trial. The following is a summary of the case.

On the afternoon of August 31, 2022, 90-year-old plaintiff was a passenger in a friend’s car enjoying an outing to lunch and sightseeing. As they traveled home they were struck by a box truck that failed to yield at an intersection, resulting in severe injuries for all passengers. Before the crash, plaintiff was a vibrant 90-year-old who spent most of her days helping her community by delivering food to homebound, disabled residents and nursing homes. She ran the food bank for her church and devoted her life to others. After the crash, she underwent a series of operations that repaired her broken bones but left her wheelchair-bound due to the associated pain complications with healing. She was stripped of her independence.

The parties engaged in mediation several months before trial, which was unsuccessful. Following mediation, the parties engaged in further discovery including a series of depositions of corporate representatives, which required several court orders for the production of materials sought by the Plaintiff. In the two months leading up to trial, the parties appeared at nearly a dozen hearings for the argument of over two dozen pre-trial motions and motions in limine.

Within a week of the trial date, the defendant company offered $10.3 million to resolve all claims for the Plaintiff. This offer came days after her 94^th birthday. The Plaintiff accepted the offer resolving all claims.
